These Terms and Conditions (“Terms”) govern the use of services offered by Technical Report Journals (TRJ), including agreements formed through technicalreport.org (and any subdomains) and through related email communications. By accessing our websites, submitting a manuscript, requesting publishing services, or otherwise using TRJ services, you agree to these Terms.


1. Scope and Definitions

1.1 Applicability

These Terms apply to contracts and service relationships formed:

  • via technicalreport.org and any subdomains (the “Website”), and/or

  • through direct communication with TRJ (including email),
    and to any related publishing, editorial, and technical services provided by TRJ.

1.2 “Customer”, “You”

In these Terms, “Customer”, “You”, and “Your” refer to any individual or entity using the Website or requesting/receiving services from TRJ, including authors, corresponding authors, and (where relevant) institutions acting on their behalf.

1.3 Conflicting terms

Any terms proposed by the Customer that differ from these Terms do not apply unless TRJ expressly agrees to them in writing.

1.4 Related policies

The following policies are part of these Terms by reference:

  • TRJ Website Terms of Use (if you publish a separate page, link it here),

  • TRJ Privacy Policy (published on technicalreport.org),

  • TRJ Publication Ethics and any journal-level editorial policies,

  • TRJ Copyright & Licensing / Open Access policy.

1.5 Order of precedence

If there is a conflict between these Terms and any other information on the Website or in communications, these Terms prevail unless TRJ explicitly states otherwise in writing.


2. TRJ Services

2.1 What TRJ provides

TRJ provides services related to scholarly publishing, which may include:

  • receipt and processing of manuscripts,

  • editorial handling and peer review coordination (journal-specific),

  • production support (copyediting, layout/typesetting, proofreading),

  • online publication and dissemination of articles and metadata.

2.2 Indexing, rankings, and third-party listings

TRJ may take reasonable steps to improve the visibility of journals and articles (e.g., sharing metadata with databases and discovery services). However:

  • TRJ does not guarantee inclusion in any index, database, ranking, or repository,

  • TRJ does not control decisions made by indexing services or ranking providers,

  • TRJ is not responsible for changes such as inclusion, exclusion, or reclassification by third parties.


3. Submission and Ordering of Publishing Services

3.1 How a contract is formed

A request for TRJ publication services is made when You submit an original scholarly manuscript (“Manuscript”) for editorial assessment, peer review, and possible publication. If the Manuscript successfully completes editorial processing and is accepted, it becomes a published scholarly article (“Article”).

3.2 Eligibility

You confirm that you have legal capacity to enter into these Terms. If You submit on behalf of an institution or other entity, you confirm that you have authority to bind that entity.

3.3 Author responsibilities at submission

By submitting a Manuscript, You confirm that:

  • the work is original and has not been submitted elsewhere (unless clearly disclosed),

  • all listed authors meet authorship criteria and approve the submission,

  • required ethical approvals and participant consents (if applicable) have been obtained,

  • conflicts of interest and funding sources are disclosed,

  • all third-party copyrighted materials have appropriate permissions.


4. Open Access, Fees, and TRJ’s Diamond Model

4.1 Diamond Open Access (no APCs)

TRJ is a diamond open access publisher. This means:

  • readers can access published content freely,

  • authors are not charged article processing charges (APCs) for standard publication.

4.2 Optional paid services (if any)

TRJ may offer optional author services (e.g., extensive language editing, complex figure redrawing, specialized formatting) for a fee only if:

  • the service is clearly described,

  • the price is disclosed in advance, and

  • you explicitly request or approve the service in writing.

No fees apply by default to submission, peer review, or standard publication under TRJ’s diamond OA model.

4.3 Taxes

If any paid optional service is purchased, any applicable taxes (e.g., VAT) are handled according to the invoice and applicable law. Unless stated otherwise on the invoice, the Customer is responsible for any bank charges or transaction fees.


5. Withdrawal, Cancellation, and Termination

5.1 Author withdrawal during review

You may withdraw a Manuscript during editorial evaluation and peer review by notifying the editorial office. If production work has already begun based on your request (e.g., paid optional services), TRJ may charge for completed optional work only if such charges were disclosed and agreed in advance.

5.2 After acceptance

After acceptance, withdrawal is generally not permitted because the manuscript enters final production and becomes part of the publishing record. Exceptions may be considered only in extraordinary cases (e.g., proven ethical or legal issues).

5.3 TRJ termination

TRJ may discontinue processing of a Manuscript if:

  • it violates TRJ policies or publication ethics,

  • required documentation (e.g., ethics approvals/consent) is missing,

  • serious integrity concerns arise (e.g., plagiarism, fabricated data),

  • communication from the authors becomes abusive or non-cooperative,

  • legal risks require stopping the process.


6. Manuscript Integrity, Copyright, and Licensing

6.1 Third-party content and permissions

If you reproduce figures, tables, images, or other copyrighted content from third parties, you must obtain and retain the necessary permissions. You warrant that your submission does not infringe third-party rights.

6.2 Indemnity

To the extent permitted by law, you agree to defend and indemnify TRJ against claims arising from:

  • copyright infringement,

  • unlawful content,

  • breach of confidentiality or privacy rights,

  • misrepresentation about permissions, consent, or authorship.

6.3 Originality and multiple submission

You confirm the Manuscript is not under consideration elsewhere and has not been published previously, except where clearly disclosed (e.g., prior conference abstract, preprint, thesis, or permitted reuse). TRJ may request evidence of author approvals and may contact co-authors if needed.

6.4 License for published articles

Unless a journal specifies otherwise, Articles are published under the Creative Commons Attribution 4.0 International (CC BY 4.0) license. Authors retain copyright, and reuse is permitted with proper attribution, a link to the license, and an indication of changes.


7. Patent and Confidentiality Considerations

7.1 Patents

You are responsible for ensuring that any patent filings or intellectual property protection you require are completed before publication. Public disclosure in an Article can affect patentability in some jurisdictions.

7.2 Confidential information

Do not include confidential or proprietary information in a Manuscript unless you have the right to disclose it. TRJ is not responsible for loss of confidentiality caused by your submission content.


8. Publication of Contact Details

8.1 Corresponding author contact

Published Articles typically include the corresponding author’s email address and affiliation for scholarly communication. This contact information may be accessible publicly.

8.2 Co-author consent

If you include additional author email addresses in the Article, you confirm you have obtained each author’s consent to publish that information.


9. Version of Record, Corrections, Retractions, and Removal

9.1 Permanent scholarly record

Once published, an Article becomes the Version of Record and is intended to remain permanently available as part of the scholarly record.

9.2 Corrections and retractions

If errors or integrity concerns arise after publication, TRJ may issue:

  • a correction (erratum/corrigendum),

  • an expression of concern,

  • a retraction,
    in line with TRJ publication ethics.

9.3 Removal in exceptional cases

TRJ may remove content only in rare situations, such as:

  • a binding legal order,

  • clear violation of privacy rights that cannot be addressed by editorial notice,

  • unlawful publication creating significant legal risk,

  • urgent public safety concerns that cannot be mitigated otherwise.
    Removal or retraction does not create a right to compensation.


10. Invoices and Payments (only if optional services are purchased)

10.1 Invoicing

If you order a paid optional service, TRJ will issue an invoice to the payment contact you provide. Only invoices issued from official TRJ email domains are valid.

10.2 Payment term

Unless otherwise stated on the invoice, payments are due within 10 calendar days from the invoice date.

10.3 Overpayments and refunds

If you overpay, TRJ may refund the excess amount after deducting bank and transaction charges. Refunds after publication are rare and assessed case-by-case.


11. Limitation of Liability

To the maximum extent permitted by law:

  • TRJ provides the Website and services “as is” and “as available.”

  • TRJ is not liable for indirect or consequential damages, including loss of profit, loss of data, or reputational harm.

  • TRJ is not responsible for decisions made by third parties (e.g., indexing services, repositories).

  • TRJ is not liable for author-provided content that infringes third-party rights.

Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., intentional wrongdoing or gross negligence where prohibited).


12. Force Majeure

TRJ is not responsible for delays or failure to perform caused by events outside reasonable control (e.g., major outages, natural disasters, war, epidemics/pandemics, governmental actions).


13. Privacy

TRJ’s processing of personal data is described in the TRJ Privacy Policy published on technicalreport.org. By using TRJ services, you acknowledge that your data will be handled as described in that policy.


14. Governing Law and Jurisdiction

14.1 Governing law

These Terms are governed by the laws of Poland, excluding conflict-of-law rules where applicable.

14.2 Jurisdiction

Unless mandatory consumer protection rules require otherwise, courts located in Poland shall have jurisdiction over disputes arising from these Terms.


15. Miscellaneous

15.1 Severability

If any part of these Terms is found invalid, the remaining provisions remain in effect. The invalid provision will be replaced by a valid provision that best reflects the original intent.

15.2 Changes to these Terms

TRJ may update these Terms by posting a revised version on the Website. Continued use of the Website or services after updates become effective constitutes acceptance of the updated Terms.
